General Conditions of Sale - Clabiotech srl (v1.0)

These terms govern online purchases on www.clabio.it for customers in Italy and the EU. By submitting an order, the Customer accepts these conditions.

1. General Provisions & Identification

  • The Seller: Clabiotech srl, Via Loggia dei Pisani 25, 80133 Naples, Italy. VAT/Tax Code: 09715201217.

  • Eligibility: The service is reserved for Consumers (individuals over 18 acting outside their professional/commercial capacity).

  • Language: The contract is concluded in Italian.

2. Product Information & Availability

  • Descriptions: Images are for illustrative purposes. Packaging may change without affecting product quality.

  • Availability: Clabiotech may limit quantities or types of products. If a product is unavailable after an order is placed, the customer will be notified and fully refunded.

  • Pricing: All prices are in Euro (€) and include VAT/applicable taxes. Shipping costs are extra and shown during checkout.

3. Purchasing Process & Contract Conclusion

  1. Selection: Add products to the "Cart."

  2. Order Proposal: Complete the order form and select a payment method.

  3. Acceptance: The contract is finalized only when the Customer receives an Order Confirmation email from Clabiotech.

  4. Risk: The risk of loss or damage transfers to the Customer upon physical possession of the goods.

4. Payment Methods

The following secure payment methods are accepted:

  • Credit Cards: Visa, MasterCard, American Express, Maestro, Discover, JCB, Diners, ChinaUnionPay.

  • Digital Wallets: PayPal, Google Pay, Apple Pay.

  • Security: Transactions occur on protected lines using standard security protocols.

5. Shipping & Delivery

  • Timeline: Delivery is usually within 5 working days (maximum 30 days by law).

  • Procedure: A signature is required upon delivery. Delivery is not available for P.O. Boxes.

  • Customer Duty: At delivery, verify that the number of packages is correct and the packaging is intact. Any damage must be noted immediately on the carrier's delivery slip.

  • Invoicing: Receipts are sent via email. To request a VAT Invoice (for professionals/businesses), data must be provided during the order process; it cannot be requested later.

6. Right of Withdrawal (Returns)

  • Eligibility: Applies only to Consumers. Not available for Business purchases (VAT holders).

  • Deadline: Within 10 working days of physical receipt of the product.

  • Procedure: Send an explicit declaration via PEC (certified email) to clabiotech@pec.it.

  • Conditions:

    • Products must be intact, unused, and with seals/labels intact.

    • Return shipping costs are the responsibility of the Customer.

    • Exclusions: The right of withdrawal does not apply to personalized products (e.g., items with engravings).

  • Refund: Once the return is approved, Clabiotech will refund the product price (excluding shipping fees) within 30 days using the original payment method.

7. Warranty & Intellectual Property

  • Legal Warranty: Products are covered by the legal guarantee of conformity (Articles 129, 130, 132 of the Italian Consumer Code).

  • Authenticity: All products are guaranteed authentic and Made in Italy (excluding promotional gadgets).

  • IP Rights: The CLABIO® brand and all related images/logos are the exclusive property of Clabiotech srl.

8. Liability & Governing Law

  • Limitations: Clabiotech is not liable for indirect damages or technical inaccuracies provided by third parties, unless there is gross negligence.

  • Applicable Law: Italian Law (Consumer Code and E-commerce Decree).

  • Disputes: * Consumers: The court of the consumer's residence/domicile (if in Italy).
