PREAMBLE
The website www.clabio.it (hereinafter the “Site”) is owned by the company:

Clabiotech invites the customer to carefully read the conditions set out below before completing the purchase procedure. These General Terms and Conditions of Sale (hereinafter, “General Conditions”) may be printed and/or saved on another durable medium accessible to the Customer. The submission of a purchase order by the customer constitutes acceptance of the terms of sale published on the Site at that time.
Clabiotech complies with the regulations on distance contracts pursuant to Legislative Decree no. 206 of September 6, 2005, and subsequent amendments (the so-called “Consumer Code”), as well as those relating to electronic commerce pursuant to Legislative Decree no. 70 of April 9, 2003. These general conditions are to be considered an integral and substantial part of the contract.

These general conditions govern online purchases made via the site www.clabio.it by subjects resident in the following countries: Italy, European Union.
1. General Provisions
1.1. These General Conditions of Sale govern all distance sales of Clabiotech products (hereinafter, “Products” or “Product”) concluded on the website www.clabio.it (hereinafter, the “Site”). 1.2. The distance selling service governed by these General Conditions is reserved exclusively for consumers (hereinafter, “Customers” or “Customer”). “Consumers” are defined as natural persons over the age of 18 acting for purposes unrelated to their trade, business, craft, or profession. 1.3. The language used for the conclusion of sales contracts through this Site is Italian. 1.4. Customers are required to carefully read the General Conditions available on the Site to acknowledge, store, and reproduce them. Clabiotech will provide a copy of the General Conditions to the Customer in accordance with Article 6.10. Contracts concluded with Customers will be archived by Clabiotech for the period required by current legislation.
2. Seller Identification
2.1. The seller is Clabiotech srl, with registered office at Via Loggia dei Pisani, 25 – 80133 Naples, Italy, VAT/Fiscal Code: 09715201217, REA number NA 105 2488.
3. Product Information and Availability
3.1. Information regarding the Products, product codes, and prices is available on the Site on the page dedicated to each Product. 3.2. Graphical representations of the Products, where available, are for illustrative purposes only. Any changes to the Product packaging will not alter the quality or characteristics of the Product itself; the Customer must rely exclusively on the description and characteristics of the Product reported on the Site. 3.3. Clabiotech reserves the right to limit, at any time, the quantity and/or type of Products that can be purchased on the Site. 3.4. If one or more Products are unavailable, customer service will promptly notify the Customer. A refund for the amounts already paid will be issued using the original payment method. Clabiotech cannot be held responsible for the lack of availability of a Product.
4. Price
4.1. The price of the Products indicated on the Site is expressed in Euros and includes all applicable taxes and duties. Shipping costs, indicated separately in the order form, must be added to the price of the Products.
5. User Reviews
Reviews from users who have actually purchased and used the product are marked as “Verified Review.” In other cases, we cannot ensure that they come from users who have actually purchased the product on our site.
6. Conclusion of the Contract
6.1. The information on the Site does not constitute an offer by Clabiotech. 6.2. Before submitting an order proposal, the Customer must read all instructions provided during the purchase process (including shipping costs, right of withdrawal, and Privacy Policy). 6.3. To purchase a Product, the Customer must: (i) add the Product to the “Cart,” (ii) complete the order proposal, (iii) select the payment method, (iv) accept the General Conditions, and (v) submit the order proposal to Clabiotech via the Site. 6.4. Submitting the order proposal constitutes a binding purchase offer and creates an obligation for the Customer to pay the price of the ordered Products. 6.5. The contract is concluded when the Customer receives an “Order Confirmation” e-mail from Clabiotech. 6.6. Risk of loss or damage to the Products is transferred to the Customer when they (or a designated third party) take physical possession of the Product.
7. Payment Methods
7.1. Payment can be made via: Credit Card; PayPal; Google Pay; and Apple Pay. 7.2. Accepted cards: Visa, MasterCard, American Express, Maestro, Electron, Discover, JCB, Diners, and ChinaUnionPay. 7.3. The total amount is charged at the time of order submission, following verification of card details and authorization from the issuer. 7.4. Any bank charges shall be borne exclusively by the Customer, including in the event of a refund.
8. Shipping and Delivery
8.1. Products will be delivered to the address indicated in the order proposal. A signature is required upon delivery. Delivery to P.O. boxes is not permitted. Delivery will occur no later than 30 days from the conclusion of the contract. 8.2. Shipping costs are borne by the Customer and are highlighted separately. 8.3. Delivery usually takes place within 5 working days from the Order Confirmation (except for force majeure or remote areas). Clabiotech is not responsible for delays attributable to the carrier. 8.4. Upon delivery, the Customer must check that the packaging is intact. Any damage must be immediately contested in writing on the carrier's delivery note.
9. Invoicing
9.1. Clabiotech will issue a purchase receipt for each order. 9.2. Professionals/Companies may request an invoice during the order process by entering their billing details, including VAT number and SDI/PEC code. Invoices cannot be requested after the order has been processed.
10. Right of Withdrawal
10.1. This section applies only to Customers identified as “Consumers.” If purchasing with a VAT number (Business), the right of withdrawal cannot be exercised. 10.2. The Consumer has the right to withdraw from the contract, without specifying the reason, within 10 working days from the date of physical possession of the Product. 10.3. To exercise this right, an e-mail must be sent to the certified e-mail address (PEC): clabiotech@pec.it. 10.4. The Consumer must return the Product at their own expense. The Product must be returned intact, unused, with original seals, and in its original packaging. For hygiene and safety reasons, withdrawal is excluded if the product has been used or seals have been removed. 10.5. Return Address: Clabiotech srl - Sede Operativa e Laboratori: Via Camillo Tutini 13 - 80136 Naples, Italy. 10.6. The right of withdrawal does not apply to personalized Products (e.g., items engraved with initials).
11. Warranty and Intellectual Property
11.1. Sales are subject to the legal warranties provided by the Italian Consumer Code. 11.2. Clabiotech guarantees the authenticity of all Products. “CLABIO®” branded products are MADE IN ITALY. 11.3. The “CLABIO®” trademark, logos, images, and all intellectual property rights related to the Products remain the exclusive property of Clabiotech srl.
12. Applicable Law and Jurisdiction
12.1. These General Conditions are governed by and interpreted in accordance with Italian law. 12.2. For Consumers resident in Italy, the competent court shall be that of their place of residence. In all other cases, the Court of Naples shall have exclusive jurisdiction. 12.3. Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr/.
13. Limitation of Liability
13.1. Except in cases of willful misconduct or gross negligence, Clabiotech shall not be liable for direct or indirect damages resulting from the non-acceptance or non-execution of an order. 13.2. Information on the Site is for informational purposes only and does not replace medical advice.
14. Complaints
Any complaints must be sent to Clabiotech srl via PEC (clabiotech@pec.it) or by post to the operational headquarters. Clabiotech undertakes to respond within 10 working days.
