Returns and Refunds

  1. Right of Withdrawal and Warranty

  2. 11. Right of Withdrawal

  3. 11.1. This section applies exclusively to Customers identified as "Consumers" under Legislative Decree 206/2005 (Consumer Code). The right of withdrawal cannot be exercised if the purchase is made using a VAT number (Business-to-Business). In accordance with Article 64 of the Consumer Code, the Consumer has the right to withdraw from the contract, without specifying a reason, within 10 working days from the date the Consumer (or their authorized representative) takes physical possession of the Product.

  4. 11.2. To exercise this right, the Consumer must send an explicit statement to the Seller via certified email (PEC) at clabiotech@pec.it within the aforementioned timeframe. The communication must include order details and contact information.

  5. 11.3. If the Product has already been delivered, the Consumer must return it to the Seller at their own expense. The substantial integrity of the Product is an essential condition for withdrawal.

  6. The Customer is liable for any diminished value of the Product resulting from handling other than what is necessary to establish its nature and characteristics.

  7. Labels and seals must not be removed. For safety reasons, withdrawal is excluded if the product has been used or if security seals are broken.

  8. Products must be returned in their original packaging (or suitable alternative) including all parts, accessories, and gifts.

  9. If the Product is damaged during the return shipment, the Seller will inform the Customer within 5 working days to allow them to file a claim against the carrier. In such cases, the withdrawal request will be canceled.

  10. Returns must be sent within 10 working days of receipt to:

  12. 11.4. If the returned goods are deemed eligible, the Seller will refund the amount paid for the products as quickly as possible (within 30 days of notification). Shipping costs and ancillary fees are excluded from the refund. The refund will be issued using the same payment method used for the initial transaction.

  13. 11.5. Once a Product has been shipped, the order can no longer be canceled or modified; it must follow the return procedure outlined in this article.

  14. 11.6. In accordance with Article 59, paragraph 1, letter c) of the Consumer Code, the right of withdrawal does not apply to personalized products (e.g., items engraved with the Customer's initials).

  15. 12. Warranty, Non-Conformity, and Intellectual Property

  16. 12.1. The sale of Products is subject to the legal warranties provided by Articles 129, 130, and 132 of the Consumer Code.

  17. 12.2. In the event of a manufacturing defect or any alleged lack of conformity, the Customer must immediately contact customer support via PEC (clabiotech@pec.it) or registered mail to the Naples address listed above.

  18. 12.3. Clabiotech srl markets high-tech products. The legal guarantee of conformity for goods is provided by law to protect the Customer.

  19. 12.4. Clabiotech srl guarantees the authenticity of all Products purchased on the Site. "CLABIO®" branded products are made with premium raw materials, manufactured by Italian contractors, and are MADE IN ITALY (excluding promotional gadgets).

  20. 12.5. The "CLABIO®" trademark, along with all figurative or non-figurative marks, service marks, illustrations, images, and logos protected by copyright, remain the exclusive property of Clabiotech srl.
